Welcome to Bought! We're Bought Oy, a Finnish company (business ID 3475141-9) located at Kalevankatu 13 A 2, 00100 Helsinki, Finland. Bought is an online platform connecting Buyers and Sellers to buy, sell, and exchange items. We provide a safe environment through our Buyer Protection service, ensuring secure transactions and refunds for eligible issues. You can always reach us at support@bought.app.

Acceptance of terms

By registering to the Bought service, including the Bought application ("Application") and the website https://bought.app ("Website") (collectively the "Service"), you are bound by these Terms of Service.


Registering an account with and/or accessing the Service from your mobile device, your computer or other hardware at any time for example by clicking "I AGREE" or such other button, link or click-through, constitutes your agreement to these Terms of Service and additional instructions given by Bought in the Application or on the Website, which collectively form a legally binding agreement between you and Bought (the "Agreement").


Bought may update these Terms of Service or its Privacy Policy (available at https://bought.app/privacypolicy) from time to time. Changes may be made due to e.g. new features, legislation or official rulings (e.g. involving changes in taxes, duties or other public charges), essential and unforeseen changes in circumstances or the rise of costs (e.g. the rise of the costs our delivery partners charge us). We reserve the right to make minor changes to these Terms of Service that do not affect the key content of the Agreement without prior notice. In case we make a change to these Terms of Service that is not only minor (and that is not made due to legislation or an official ruling), we will notify you about the change at least 30 days before the change comes into effect. In case you don't accept the change, you may discontinue using the Service and terminate your Agreement with us before the change comes into effect.

Only consumers may use the Service

Only 16-year-old or older private individuals are permitted to use the Bought Service.


The Service is meant only for consumers, and it is not allowed to be used for or in connection with any business activity.

Description of the service

Bought is an online platform that allows Users to sell to, purchase from, and exchange clothes, accessories, cosmetics, electronics, home items, sports equipment, and other products ("Items") with other Users. These actions are hereinafter collectively referred to as "Transactions."


Bought provides a platform where the seller of an Item ("Seller") and the purchaser of that Item ("Purchaser") may independently carry out certain activities as further defined in these Terms of Service. The shipping send-off and pickup of the Items are handled independently by and between the Seller and the Purchaser. Bought provides only the Bought platform with certain functionalities, including the possibility to sell, offer and exchange Items to/with other Users of the Service.


Please note that the Finnish Consumer Protection Act (38/1978 as amended) does not apply to any Transactions or Items. Transactions are agreements between Users i.e. two private individuals. Sellers offer listed Items directly to Purchasers pursuant to prices, pictures and descriptions decided by each particular Seller. Bought is not a party to any Transactions and is not liable for any Transactions. The Seller and Purchaser are solely liable for carrying out the Transactions.


Please note that Bought has no control over the quality, legality, morality, authenticity or safety of the items or content listed or the accuracy or authenticity of listings. The Seller is solely liable for possible defects in Items. Bought also cannot guarantee the ability of the Sellers to sell items or complete a Transaction or the ability of a Purchaser to pay for them.


By using the Service, you understand and accept that Bought does not actively verify the material submitted to the Service by the Users and Bought's responsibility for such material is therefore limited to the fullest extent possible by applicable law.


Bought encourages you to communicate directly with potential Transaction partners through the tools available in the Application.


We aim to keep the service operational and available 24 hours a day, but, at times, we may make the Service temporarily unavailable due to maintenance, changes, installation work, safety, excessive system activity or similar reasons. We aim to perform maintenance during non-standard working hours. It is possible that the Service is, sometimes, unavailable or negatively affected due to circumstances that are beyond our control.

Changes to the Service

We are continuously developing the Service and we may change or remove different parts of the Service, including its functionalities and features, in part or in whole.


We may make modifications or changes to the Service at any time at our sole discretion and without notifying you thereof, provided that such changes are necessary for maintaining the Service in conformity with these Terms of Service and applicable laws and official rulings, including regular updates made e.g. due to new releases of operating systems.


If we introduce other changes, we will notify you thereof e.g. on the Website and in the Application. In case you don't accept the change, you may discontinue using the Service and terminate your Agreement with us before the change comes into effect. Please note that you are always entitled to terminate this Agreement by deleting your Bought account at any time as set out below.

Registration & User account

When registering to the Service, you must provide true and accurate information about yourself. You shall keep the information submitted to Bought up to date. If you suspect someone has access to your account, contact Bought customer service immediately.


Please note that you are allowed to have only one account in the Service. Your account is personal and you may not share it or your user credentials with others.

Responsibilities of the User

You are responsible for using the Service responsibly, reasonably and in good faith.


The following rules and restrictions shall apply to all use of the Service:

  • You shall be responsible for the provision of accurate, authentic and valid information and data and for keeping your information up-to-date.
  • You are not allowed to bypass or attempt to bypass the Bought payment system integrated in the Service.
  • You are not allowed to use the Service in violation of applicable laws or third-party intellectual property rights, business secrets, or privacy rights.
  • You are not allowed to send messages within the Service that are of an advertising character, contain private contact details, contain viruses or swarms or are considered insulting, sexist or racist. Sending mass messages is also prohibited.
  • You must be the legal owner of the Items you list for sale and have an unrestricted right to sell all such Items.
  • It is strictly prohibited to conduct fake sale and/or purchase activities in the Service.
  • It is strictly prohibited to sell fraudulent products or items that are illegal, broken, counterfeit, unsafe or stolen.

Responsibilities of Bought

Bought shall process the personal data of Users in accordance with applicable laws and the Privacy Policy available at https://bought.app/privacypolicy.


Bought shall inform Users beforehand about any material changes to the Service, Privacy Policy, or these Terms of Service.


Bought aims to protect the Users from frauds, identity thefts, bad transactions and other offences and therefore may use the full range of lawful measures, at its sole discretion, to investigate any breach of the Agreement.


If we find you're violating our Terms or engaging in unlawful activities, we may take corrective actions, including:

  • Sending you a warning message.
  • Removing or correcting your listed Items.
  • Hiding or removing your Content.
  • Hiding private messages you've sent.
  • Restricting your account's access to certain features.
  • Notifying local authorities if there's a threat to someone's safety.

We may temporarily or permanently block your account if:

  • You repeatedly breach our Terms despite previous corrective actions.
  • You commit a serious breach, such as providing false or misleading information, failing to cooperate with verification requests, abusing platform functionalities, or engaging in fraudulent or illegal activities.
  • Stripe (our payment provider) identifies suspicious or unlawful activities related to your account.
  • There are serious issues with your transactions, safety concerns, or security threats.
  • You are under 16 years old.

When your account is blocked:

  • Your Items will be removed from the platform.
  • You won't receive refunds for any optional Services you've purchased.
  • You may complete pending transactions and payouts unless your account is blocked due to security or fraud concerns. In such cases, pending transactions may be cancelled, fees refunded to Buyers, and your ability to make payouts restricted.
  • We may reject compensation claims if your account was blocked due to fraudulent or unlawful activities.
  • We may prevent you from creating a new account.

Transactions

When you decide to sell an Item, you must upload an accurate description and photo(s) of the Item. You are only allowed to list a single Item once, using only photos of the Item you have taken yourself or you are otherwise entitled to use for the said purpose.


Bought reserves the right to delete or modify any Item in the Service in case the Seller has violated the Agreement or if the listing of the Item or the uploaded photos thereof are otherwise unclear, of bad quality or otherwise inaccurate.


Following the confirmation of a Transaction through the Service and payment of the required amount by the Purchaser, Bought will notify the Seller, after which the Seller must ship the purchased Item within five (5) days after confirmation of the Transaction. Upon receiving the confirmation of the delivery of the Item and after the Purchaser has accepted the Item, Bought will credit the Seller's Bought Balance in an amount equal to the purchase price received from the Purchaser.


If the Purchaser does not respond/submit a complaint within 2 calendar days from our notice that the Item has been delivered (the Refund Request Period), the purchased Item will be deemed accepted and the Transaction will be automatically completed.


After completing Transactions, Users of the Service are entitled to write reviews about other Users with whom they have completed Transactions. You may only post reviews that are justified, honest and respectful. Submitting lies, insults and false information as feedback is strictly prohibited. Bought reserves the right to modify or delete any feedback posted through or within the Service.

Shipping

In case the Seller and the Purchaser opt for the shipping option provided by Bought for the delivery of the Item, the Seller packs the Item carefully after the payment has been made by the Purchaser. The Seller will thereafter receive a code/identification through the Service and take the packed Item with the code/identification to any drop point provided in the Service. The Seller is responsible of ensuring that the packed Item is duly protected for the shipment and delivery, received and handed over to the right advocate (cashier) working for the logistics companies that Bought is co-operating with and that the packed Item has been noted and accepted as received by the logistics company following the instructions given in the Service.


The logistics company will track the delivery and notify both the Seller and the Purchaser when the Item is ready to be collected from the service point chosen by the Purchaser or when the Item is delivered to the Purchaser's home. The time within which the Purchaser has to pick up the package shall be defined in the notification the Purchaser receives from the logistics company.


In case the Purchaser fails to pick-up the Item during the time stated in the notification from the logistics company, the package shall be returned to the Seller. The Purchaser shall not be entitled to a refund of the purchase price or any other compensation in case the Purchaser fails to pick-up the package.

Payments & Fees

Bought uses Stripe as its third-party service provider for payment services (e.g. card acceptance, settlement, and other services) ("Payment Services"). By listing or selling items on the Service you also agree to be bound by Stripe's Seller Terms and Privacy Policy, and hereby consent and authorize Bought and Stripe to share any information and payments instructions you provide with third-party service provider(s) to the minimum extent required to complete your Transactions. Stripe will on behalf of Bought verify your credit card information (including expiration and billing address) but will not charge your credit card unless you conduct an activity through the Service that requires your credit card to be charged. By agreeing to pay for a Transaction with your credit card or with another payment method, you authorize Stripe to on behalf of Bought charge your credit card or to charge you through another payment method.


Purchasers of Items are responsible for paying 1) the purchase price of the Item, 2) the Buyer Protection fee, and 3) the shipping fees. The applicable Buyer Protection fee together with shipping options and their prices are set out on the Item's listing page.


Bought doesn't have any selling fees, and therefore the Sellers of Items are responsible for paying only the price of potential optional services offered by Bought, e.g., related to faster or improved shipping experience. The applicable optional services, if any, are set out in the Service.


Sellers are also responsible for all income taxes associated with the purchase and sale of any Items through the Service and for making all necessary tax statements and notifications to relevant authorities in case the said obligations apply. Please note that Transactions shall be carried out between private individuals who are consumers and therefore no VAT is payable. In case the nature of the Transactions of a Seller may be regarded as commercial in the sense that VAT is applicable, the Seller must discontinue using the Service as the Service shall not be used for the commercial sale of goods.

Bought Buyer Protection

Buyer Protection provides you (the Purchaser) with a refund policy if an Item is wrong, lost, faulty, fake or significantly not as described (Refundable Item). Your payment will be held in escrow until the Transaction is marked as completed. To clarify, Buyer Protection is not an insurance or a legal protection service and is in addition to all other legal rights or guarantees you have. Buyer Protection is mandatorily applied for a fee and for each purchase made using the Payment Services provided by the Service.


If there are any issues with the Item you have received, you must report the issue under our Buyer Protection policy to us by clicking the "I have an issue" button in the Transaction chat within 2 calendar days from our notice that the Item has been delivered (the Refund Request Period). This will suspend the Transaction and all money for it will continue to be held in escrow until the issue is resolved. If you don't report an issue to us within the Refund Request Period, the Transaction will automatically be marked as completed and the purchase cannot be refunded any longer. Also, if within the Refund Request Period you already have marked the item as OK, the refund request cannot be processed any longer.


We suggest discussing with the Seller first to explain what issue you're experiencing so you and the Seller can agree on a resolution you're both happy with. But if you're unable to reach a solution, you can at any point escalate the issue to us by contacting our Customer Support.


If you claim an Item is Refundable within the Refund Request Period, we'll notify the Seller about this. The Seller can either:

  • not require you to return the Item to them and grant you refund, or
  • require you to return the Item to them within 5 business days in order to receive a refund. The Seller will be responsible for return shipping costs unless agreed or decided otherwise, and we'll notify the Seller once they should have received the Item or if it appears to be lost. From the time we notify the Seller, they'll have again 2 days to confirm they have the Item and everything is ok (at which point you'll receive your full refund) or report an issue (in which case your money will still be kept safe in escrow until the issue is resolved). If the Buyer purchased Items as part of a bundle they can return only the Refundable Item(s) out of the bundle.

If the Seller doesn't take one of the above actions within 14 days of you reporting the issue, or if you or the Seller report an issue to us at any point during this process, Customer Support will make the final decision on whether an Item is Refundable.


If an issue is escalated to us: We'll review your case and may ask you and the Seller to provide us with information and evidence to inform the objective decision about whether your case is eligible for a refund. You and the Seller agree to respect the final decision.


What is covered under the Buyer Protection?

  • The Item is lost during delivery.
  • The Item is significantly not as described.
  • The Item is a counterfeit.

The Purchaser of the Item must accurately and adequately demonstrate that the purchased Item does not match the Seller's description. However, the Buyer Protection does not, inter alia, cover the following situations:

  • The Purchaser's remorse.
  • The Item is not your style.
  • The Seller's images and description accurately describe known flaws.
  • The Item has a displeasing smell.
  • The colour of the Item is slightly different than expected.
  • The size of the Item was listed accurately, as it is given on the manufacturer's tags but the Item does not fit you as expected.

Furthermore, common reasons for not being eligible for refund under Buyer Protection include:

  • you reported an issue with an Item but it's determined as not a Refundable,
  • you already confirmed that everything was ok with the Item when you received it,
  • you didn't report the issue to us within the Refund Request Period,
  • you didn't provide Customer Support with proof an Item was Refundable within timelines communicated to you,
  • you used, washed or changed the Item in some way before you returned it, or
  • you are under investigation because you're suspected of abusing or misusing the Buyer Protection by claiming the refund.

Changes to prices

We reserve the right to change our pricing at any point. Changes may be made due to e.g. new features, legislation or official rulings (e.g. involving changes in taxes, duties or other public charges), essential and unforeseen changes in circumstances or the rise of production, purchasing or other costs (e.g. the rise of the costs our delivery partners charge us).


In case we amend the Buyer Protection Fee, the shipping costs or any other costs or introduce a new fee, we will notify you about the change before the change comes into effect. In case you don't accept the change, you may discontinue using the Service and terminate your Agreement with us before the change comes into effect.

Third party services

You may register for the Service via third-party services (e.g., Google) and otherwise enable various third-party services to be directly integrated into your Bought experience. By enabling third party services within the Service, you are allowing us to pass your log-in information to these service providers for this purpose. Please remember that the manner in which third-party services use, store and disclose your information is governed solely by the policies of such third parties. Bought enables these features merely as a convenience and the inclusion of such features does not imply an endorsement or recommendation.

Personal data and privacy

As part of providing the Service, Bought processes personal data of Users.


Bought takes the protection of your personal data seriously. We are dedicated to complying with all applicable data protection laws, including the EU General Data Protection Regulation (GDPR).

Bought Balance

Bought Balance is an electronic wallet available on the Bought platform. You can use your Bought Balance to receive and store funds for an Item you sell, buy an Item from another User using funds in your Bought Balance, transfer funds from your Bought Balance to your personal bank account (a Payout), or purchase optional Services available to Buyers and Sellers.


Any User can set up a Bought Balance. If you're a Seller, you must activate your Bought Balance after making your first sale.


To activate your Bought Balance, go to your Profile, select Bought Balance, and then provide your full name, address, and bank account details. You may also be asked for additional information such as your date of birth, nationality, or phone number.


Our payment provider (Stripe) requires you to complete identity verification checks ("Know Your Customer" or KYC). These checks are required by law to prevent fraud and money laundering. You may need to provide documents such as your passport, ID card, driver's license, bank statement, or proof of residency if you reach certain transaction or payout thresholds, or if Stripe suspects fraudulent, suspicious, or illegal activity related to your Bought Balance.


If you fail or do not complete the KYC Check, you won't be able to activate or continue using your Bought Balance. Your Bought Balance may be suspended, preventing you from making purchases or payouts. Stripe may also apply these limitations if they suspect fraudulent, suspicious, or illegal activity.


To request a payout, go to your Bought Balance and press the Cash out button. If you're located in the eurozone, payouts can only be made in euros to a personal bank account within the European Union or European Economic Area. If you're located outside the eurozone, payouts can only be made in your local currency and within your home country. Payouts in other currencies or outside these regions are not permitted.

Intellectual property rights

All intellectual property rights to the Service, including but not limited to software, technology, text, trademarks, logos and graphics and any modifications, derivations or adaptations thereof (collectively "Material"), shall be vested in and remain as the sole property of Bought or its licensors or partners with all rights reserved. No Material regarding the Service are transferred to the User.


Subject to Users' compliance with the Agreement, Users are granted a personal, limited, non-exclusive, non-transferable and revocable right to use the Service.


All unauthorized use of the Material is prohibited. You must retain all copyright and other proprietary notices, as the case may be, contained in the original Material on any copy you make of the Material.


You may not sell or modify the Material or reproduce, display, publicly perform, distribute, or otherwise use the Material in any way for any public or commercial purpose. The use of the Material on any other website, mobile application or in a networked computer environment for any purpose is prohibited.


You are not allowed to copy, modify, distribute, rent, sublicense, lease or otherwise make the Service available to third parties without prior written consent of Bought. You are not allowed to circumvent or try to circumvent, probe, scan, test the vulnerability, reverse engineer or decompile or access the source code of any functionalities of the Service except as permitted by law.

User content

Users shall not upload, post or otherwise make available (or submit to Bought for uploading, posting or to be made available) on the Service any material protected by copyright, trademark or other proprietary right if such action constitutes an infringement of said proprietary right. Users shall be solely liable for any damage resulting from any infringement of intellectual property rights or any other harm resulting from such a submission.


By submitting any content to the Service, you hereby grant Bought a royalty-free, worldwide, perpetual, non-exclusive and transferable right and license to use, reproduce, modify, publicly display (in whole or in part) such content within the Service and for Bought's marketing actions and other commercial purposes without your prior approval or the payment of any compensation. Users take full and sole responsibility for all content that they post on the Service and the consequences of posting such content. Users are responsible for obtaining all necessary rights to upload, post and distribute all content.


You acknowledge and agree that when you create a listing for an Item on the Service, you automatically grant Bought and its Users the right to display, edit, modify and otherwise use and reuse the photos you submitted with the listing (or any portions thereof) in any manner, in any medium now known or hereinafter created, for the purpose of relisting and reselling the same Item on the Service.

Limitation of liability

Neither Bought, its affiliates nor any of their respective employees, contractors, agents, third-party content providers or licensors warrant that use of the Service will be uninterrupted or error free; nor do they make any warranty as to (i) the results that may be obtained from use of the Service, or (ii) the accuracy, reliability or content of any information, service or product (including Items) provided through the Service.


In case Bought breaches the Agreement, it shall be liable for damages in accordance with the Consumer Protection Act. This section does not limit our statutory liability for defects in the Service in relation to our consumer customers or any liability that, by law, cannot be limited or restricted, or your statutory remedies for defects or delays under any applicable mandatory consumer protection laws, including the Consumer Protection Act.

Governing law and dispute resolution

Please note that the provisions of this section do not apply to disputes between Users or disputes regarding any Items, for example claimed defects in Items. Transactions are agreements between the Users. Any disputes or claims relating to any Transactions or Items shall be handled by and between the Purchaser and the Seller.


The Agreement shall be governed by the laws of Finland, excluding its conflicts-of-law provisions.


Any disputes arising out of this Agreement and the Service shall be settled by the District Court of Helsinki as the court of first instance. Consumers are, however, entitled to choose to bring action in either the applicable court of first instance in their home jurisdiction or in the District Court of Helsinki.


In case of disputes regarding this Agreement or Service (not concerning Items), you may as a consumer also contact the Consumer Advisory Services (https://www.kkv.fi/kuluttajaneuvonta/) and thereafter refer your case to the Consumer Disputes Board (https://www.kuluttajariita.fi) for resolution.


As a consumer, you may also use the European Online Dispute Resolution Platform (ODR) provided by the European Commission for resolving consumer problems. The ODR (http://ec.europa.eu/odr) provides access to dispute resolution tools in all official EU languages.
